Tax notes: Extension of ITR deadline to April 17

The Bureau of Internal Revenue (BIR) has extended the filing deadline for the Annual Income Tax Return to April 17 since the statutory April 15 deadline falls on a Saturday.

The BIR has also adopted the following interim measures to facilitate compliance by the taxpaying public:

1.Head offices and certain branches of Authorized Agent Banks (AABs) will extend banking hours to 5 p.m. from April 1 to 17 and open on two Saturdays on April 1 and 8 prior to the April 17 deadline. Banks shall not turn away taxpayers who are within their premises by the close of banking hours on April 17, 2006.

2.Payment with two or more checks for a single tax liability shall be allowed provided that the checks are made in accordance with Revenue Regulations (RR) 16-2002. Under RR 16-2002, the taxpayer should indicate in the space provided for “PAY TO THE ORDER OF” the following data: (1) presenting/collecting bank or the bank where the payment is to be coursed and (2) FAO (For the Account Of) Bureau of Internal Revenue as payee; and under the “ACCOUNT NAME” the taxpayer identification number.

3.Out-of-district income tax returns shall be accepted by AABs without imposing penalties to taxpayers for wrong venue provided that the AAB shall indicate its Revenue District Office No. in the LBDES field (not the RDO of the taxpayer) and stamp the words “Out of District” on the taxpayer’s return.

4.Photocopy or electronic/computer-generated BIR forms may be used in lieu of officially printed forms subject to the following conditions:

·The forms are originally filled up.

·Computer-generated forms are of laser quality and printed in a white 8 1/4 x 13 or 8 1/4 x 11 class A (56 SM) paper stock using black ink.

5.BIR shall field additional personnel and open additional counters to ensure servicing of the taxpayers. (Source: Punongbayan & Araullo)
