Capitol wins case vs. occupants of gov’t lots

Occupants of the Province-owned lots at the back of the Cebu South Bus Terminal will have to pack their things and move to their relocation site.

The court, ruling in favor of the Cebu Provincial Government, ordered occupants to vacate the site and demolish all structures that they made after the fire last year.

Municipal Trial Court in Cities Executive Judge Francisco Seville released his ruling last Monday.

The occupants may still ask the court to reconsider. But for now, said Capitol consultant Pablo John Garcia, “there is no stopping the Capitol to take over the property.”

“Capitol will retake the possession of the lots. As to when, it will be the call of the governor. Although it was not Capitol’s obligation, we offered a relocation site for them,” Garcia said.

Capitol offered a relocation site for some 30 families in Kalunasan.

Garcia said some of the occupants had moved to their relocation lot in Kalunasan, but others refused and continued to question the Province’s ownership of the lot.

“The court has already spoken. There is no legal basis for their stay,” Garcia said.

Provincial Treasurer Roy Salubre is working with members of the South Bus Terminal Homeowners Association regarding their relocation.

Residents had said the Capitol, during the time of then governor Emilio Osmeña, promised to sell them the lots.

But during the time of former governor Pablo Garcia, they were sent notices to vacate and be relocated to Barangay Kalunasan.

Capitol is planning to expand the Cebu South Terminal because it is now overcrowded. It also explored the option of putting up a farmer’s market there. (MBG)
