Fanciful marks By What is a fanciful mark? I protect
Fanciful marks are words specially created for the sole purpose of functioning as trademarks. These marks do not have any intrinsic or real meaning. Some famous examples are Xerox and Kodak.
Inherently distinctive fanciful marks are the “strongest” of all marks and are easy to protect. If sufficiently advertised, fanciful marks will have a substantial impact on the buyers’ minds.
A fanciful mark’s novelty as a word-mark for a product may require a great effort of advertising to be recognized by consumers.
If advertisement of the fanciful mark is successful, the association created between the mark and the new product would be tremendous.
