Only my doc can check me: Ecleo
Ruben Ecleo Jr. believes the only competent person who can assess his health is his Manila-based personal physician.
Ecleo, through his lawyers, formally opposed the prosecution’s motion to have him undergo a medical examination by government doctors in Cebu.
The defense instead asked the court to order Ecleo’s cardiologist, Dr. Roberto Anastacio, to submit his findings on the condition of the accused.
According to the six-page opposition and motion, Ecleo is continuously undergoing medical treatment.
“(Ecleo) reports to his cardiologists at the Makati Medical Center every now and then for medical surveillance and is strongly advised to avoid stressful situations and areas,” it read.
This was in answer to the allegation of the prosecution that Ecleo appears to be healthy every time he appears in court for hearing.
Ecleo is facing trial at the sala of Cebu City Regional Trial Court Judge Geraldine Faith Econg for allegedly killing his wife Alona Bacolod-Ecleo in January 2002.
If Cebuano government doctors confirm the pro-secution’s speculation, then Ecleo should be sent back to jail, the prosecution’s motion said.
Ecleo was allowed to post a P1-million bail two years ago on the sole basis that his failing health requires constant medical attention not available inside the Cebu City jail.
Defense lawyers Giovanni Mata and Orlando Salatandre recalled that immediately after Ecleo posted bail, he was admitted at the Makati Medical Center for half a month.
Ecleo’s medical results show that he is suffering from ischemia or tissue anemia due to obstruction of the inflow of arterial blood.
“A coronary artery disease is not similar to simple colds or cough where clinical history, previous examinations, procedures and work ups are no longer needed in conducting an examination by the new physician,” the defense’s motion read.
This is why the defense would prefer if Anastacio would first be called to testify in court rather than subjecting Ecleo to medical exam.
“It is premature and baseless to require the accused to submit himself for medical exam by new physicians without first knowing his present health condition,” Mata and Sala-tandre added. (JGA)
