Seares: Kicked in the ass

There's this story about US financier Russel Sage who told his lawyer facts of the case he wanted to take to court.

"It's iron-clad," the lawyer said, "we can't possibly lose."

Then we don't sue, said Sage, I just gave you the opponent's side.

I don't think Cebu City Mayor Tomas Osmeña did that when he plotted a lawsuit against Talisay City.

People sue mostly because, hurt and angry, they want to hit back.
The mayor wanted to get even at Rep. Eddie Gullas who messed up his mind about South Road Property (yes, the controversial SRP, renamed but with same acronym).

As SRP is Tomas' baby, Talisay City is Eddiegul's. What better target for return fire?

So Tomas went to Court of Appeals to assail Talisay's cityhood.

Had he looked at his foe's case, CA's two major arguments, and Talisay City's as well, would have stared at him: motive and standing.

Oddly, question of motive (which he used against Eddiegul's SRP claim) didn't occur to the mayor.

Didn't he demean Talisay's SRP bid by asking "Why only now?" The CA now throws that at Tomas and it stings more.

"Locus standi" (personal and substantial interest), was lost on the mayor too. He probably thought it meant his interest, which he often confuses with Cebu City's.

The CA rules: Cebu City has no business with Talisay's status. If you don't see that as kick in the ass, you don't know what is.
