Fiscals ask for 3 physical tests on suspect Ecleo
The prosecution in the parricide case against Ruben Ecleo Jr. found their own cardiologist whom they want to physically examine him.
The panel of prosecutors, headed by lawyers Fritz Quiñanola and Alfredo Sipalay, named Dr. Generoso Matiga of the Vicente Sotto Memorial Medical Center as their cardiologist.
In a motion, the prosecution noted that Matiga recommended three tests to be conducted on Ecleo as basis for an analysis on his health.
He is on trial in relation over the killing of his wife, Alona Bacolod on Jan. 5, 2002.
Ecleo’s heart problem was the sole basis for then presiding judge Generosa Labra to grant him provisional liberty in 2004.
The prosecution recently revisited the issue continued that the cult leader can already withstand going back to jail.
Great need
“There appears a great need to subject the accused to an impartial medical examination to determine whether the medical or health reasons for which the accused was granted bail still exists,” Quiñanola earlier said.
Matiga, according to the prosecution’s motion, recommended for a coronary angiogram, 2D echocardiogram with Doppler (ultra sound for the heart) and treadmill stress test.
But since Ecleo already presented the results of his coronary angiogram in Manila, Matiga suggested he just undergo the two other tests, preferably at the Perpetual Succor Hospital where the doctor is holding regular clinic hours. The prosecution asked the court to order Ecleo to submit to a medical examination within 15 days.
No signature
But the defense failed to present Ecleo’s doctor during the May 12 hearing.
Defense lawyer Orlando Salatandre said the subpoena for Dr. Roberto Anastacio did not have presiding Judge Geraldine Faith Econg’s signature.
Anastacio is based at the Makati Medical Center. He was tasked to bring in Ecleo’s medical records in court.
“Since the health condition of a person... varies on a day to day basis, the issue of health or physical fitness to withstand the difficulties of being in jail can be determined by the trial courts,” read Econg’s earlier order allowing the physical examination of Ecleo. (JGA)
