BIR readies legal charges vs. 2 tax evaders in region

While many entities and individuals are suspected of violating tax laws, the Bureau of Internal Revenue (BIR) 13 Cebu Revenue Region has recommended only one case for legal action.

The case has been forwarded to the BIR national office, said BIR 13 taxpayer’s assistance unit head Zorahaida de la Cruz.
“We are in the process of recommending another one,” she told Sun.Star Cebu.

She said only one case has been recommended for legal action so far because the internal revenue office has to gather enough evidence against violators.

“It’s not easy to file because we need to have solid ground,” she added.

The BIR 13 Cebu Revenue Region covers five districts: Mandaue City, Cebu City north, Cebu City south, Talisay City and Tagbilaran City in Bohol.

De la Cruz said common violations of taxpayers were related to non-declaration of income and “over-claims” or excessive claims on expenses. She declined to give more details.

De la Cruz stressed, though, that tax compliance in Cebu and Bohol is very high.

“Taxpayers in this region are more educated. They know the rules and regulations,” she said.

She said the BIR investigates supplies and purchases declared by taxpayers. Receipts, invoices issued and inventories must support the declared amount of supplies and purchases of the taxpayer.

If records don’t match, a taxpayer will be suspected of trying to evade tax payments. Once an individual or an entity is suspected of violating tax laws, the BIR issues a notice and prescribes a certain period for the taxpayer to comply with requirements.

“There is still due process,” de la Cruz assured.

However, she said that once BIR recommends the filing of charges and forwards the case to its national office, there will no longer be any settlement. (MMM)
