Gwen joins complainant in admin case
Cebu Gov. Gwendolyn Garcia is joining a Mactan airport official as a complainant in the cases he filed against former general manager Adelberto Yap before the Office of the Ombudsman-Visayas.
The governor’s lawyer filed yesterday her manifestation in support of the complaints filed by Rogelio Yaun, manager for administration at the Mactan-Cebu International Airport Authority (MCIAA). She joins the case in her “personal capacity, as a member of the MCIAA board and as governor of the Province of Cebu.”
“I’ve seen the documents and more documents keep pouring in. I urge all Cebuanos whose sense of decency has been so flagrantly violated by the actuations of General Yap, in his capacity as general manager, to join me as well in the cases that are already filed. Gibogoan na lang gyud siya sa mga Cebuanos? (Does he think Cebuanos are stupid?)” Garcia said.
Yaun has filed a case of falsification of documents after Yap allegedly submitted to the Civil Service Commission (CSC) a falsified copy of Republic Act 6958 or the MCIAA Charter, to justify his appointment.
Section 7 of the charter states that the board appoints the general manager of the authority.
But the falsified copy has an added phrase after the word authority: “(upon) nomination by the President of the Philippines.”
Yaun has also filed four other cases against Yap, including one over an allegedly questionable purchase of a radio repeater and three batches of handheld radios, which were described as overpriced.
“After a thorough evaluation of the facts and circumstances surrounding the cases and finding enough evidence of wrongdoing on the part of respondent Yap, I have decided to join Atty. Rogelio Yaun as party complainant in the cases,” the governor’s manifestation stated.
Garcia said she is not threatened by Yap’s pronouncements that he will soon “expose” her.
“(He said) Di ta magminaot. Well, speak for yourself. I can look you straight in the eye because my conscience is clean. Is your conscience clean?” Garcia said.

She also confirmed the airport board is reviewing the financial status of the airport.
Also yesterday, Garcia was furnished a copy of the audit observation memorandum dated Sept. 22, 2005 of the Commission on Audit, regarding Yap’s leave credits.
COA audited the payments for the former manager’s leave credits, which amounted to P130,432.08. That represented 112 accumulated leave credits at the Air Transportation Office (75.334 days) and the Clark International Airport Authority (37.08 days).
In its report, the COA said it found the disbursement irregular and recommended that Yap be asked to refund the total amount.
COA explained that his leave credits at ATO could no longer be transferred to MCIAA because one year and five months have lapsed, and the omnibus rule on leaves states that the option to transfer accumulated leave credits can be exercised within one year only from the employee’s transfer to another agency.
