IBP to meet CIDG, Gerry on shop raid

Cebu City Councilor Gerardo Carillo, his clients and the Criminal Investigation and Detection Group 7 led by CIDG Chief Jose Jorge Corpuz will face off today.

The Integrated Bar of the Philippines (IBP) Cebu City chapter in their board meeting passed a resolution creating a seven-man fact-finding panel that will meet both sides today.

IBP Cebu City chapter president Alex Tolentino said the meeting with Carillo, his clients, Corpuz and members of the CIDG raiding team is part of their plan to gather more information on allegations that the city councilor intervened in CIDG’s operations last Friday.

“We want to come up with a solution kung unsay maayong buhaton in the future. We are members of the five pillars of justice. If there is a problem, it is better if all parties meet and talk about it,” said Tolentino, who will head the panel.

He said the IBP is merely creating a venue for both sides to air out their concerns instead of exchanging statements through the media.

“We will find out what really happened from both parties. I think this is a better way of doing things,” Tolentino further said.

He already called up Carillo and Corpuz to inform them of today’s meeting and both said they will attend.

In a separate interview, Corpuz denied committing irregularities in conducting a raid on a shop suspected of selling fake whitening facial cream.

One of the alleged owners identified by CIDG 7 belied the report and pointed out he was only a visitor at the shop.

Corpuz told reporters yesterday his operatives never tried to extort money from the owners of Yu Lian Marketing, one of the six shops raided last Friday afternoon.

The six simultaneous operations were done after Judge Ramon Daomilas of Regional Trial Court (RTC) Branch 11 issued the search warrants.

Of the other six shops, only the owners of Yu Lian Marketing, located along Legaspi St., were identified—Key Jinky, Ben Dy and John Sanchez.

In fact, Corpuz said Sanchez signed the inventory receipts of the items seized by the operatives.

CS Trading, the exclusive distributor of genuine Top-Gel—a whitening facial cream product—also pointed to Jinky, Dy and Sanchez as the owners of the shop, he said.

Representatives from CS Trading, which served as the complainant, were also around during the simultaneous raids.
Corpuz said he welcomes the investigations by the Office of the Ombudsman-Visayas and the IBP.

He also reiterated his willingness to furnish Cebu City Mayor Tomas Osmeña a copy of their report that narrated the alleged intervention and promise of Councilor Carillo to bring the three suspects to the CIDG 7 headquarters.

“CIDG is not clean. But in this particular case, there was no irregularity. It was just a plain implementation of IPR (Intellectual Property Rights) Law,” Corpuz said.

Dy, in an interview with Sun.Star Cebu yesterday, denied he is one of the owners of Yu Lian Marketing.

He recalled that when the CIDG 7 raided Yu Lian Marketing, he was in the store because he was using the telephone in making a free long distance call to Negros.

He said Jinky was also inside the store. He, however, has no idea if Jinky works or owns the shop.

He also told the operatives that he did not know the owner of the shop.

The CIDG 7, however, insisted he was one of the owners, prompting him to ask if he could see the copy of the search warrant.

He found out his name was in the search warrant.

The operative then told him that he is being placed under arrest.

A certain “Hanipa” later called up Carillo for assistance.

“He (Carillo) did not interfere. He only looked at the search warrant,” Dy said, adding that the councilor did not stay long in the shop.

After the raid, the CIDG 7 told them that they will just be taken to the headquarters for questioning.

Dy said he does not want to get involved in any case but if the CIDG 7 insists on filing a complaint against him, he might consider filing counter-charges against the police.

The seven-man panel of lawyers that will look into the incident includes IBP Cebu Province president Ronnie Gocuan and Vice President Noel Adlawan.

They will be joined by Mandaue Law Association president Raul Sanchez, Mactan Island Lawyers’ League president
Dominador Amores and IBP Cebu City board members Gloria Lastimosa-Dalawampu and Democrito Barcenas.

Tolentino said the panel will come up with recommendations after their close-door conference tomorrow. (Malou Inocando-Tabar, Correspondent/JST )
