EVEN law students saw the hopelessness in Cebu City questioning the legality of Talisay as a city.
Official acts of government are presumed to be regular. Courts looked at evidence and saw no reason to strike down the presumption. Court of Appeals, denying Cebu City's motion to reconsider an earlier rebuff, was blunt and clear: no case.
Courts apparently recognized Cebu City's motive. Other than illusory fear of loss of income, judges must have seen ill will and spite in the move to strip Talisay of cityhood and afflict Talisaynons.
More than the law, I said in a 2005 column, is the impracticality, the pointlessness.
What good would reverting Talisay to a town do? On the other hand, what a lot of injury it would inflict.
If the purpose is to punish those who "tampered" population figures, prosecute them. But why go after them now, why raise the issue only when agencies of government, local and national, had long decided on Talisay's status?
It's the hate
Purpose of the lawsuit, of course, is not public interest. It is active, exploding hate of Tomas towards Eddie Gullas, former Talisay mayor, now district congressman, whom he accused of bringing heavy downpour on his SRP parade.
Mayor Tomas said he'll go to the Supreme Court. His right.
An owner can flog his dead horse but what does it tell the public? Frustration, maybe loss of touch with reality.
