THIS is with reference to the news item, “Couple Denies selling stolen vehicle to woman” (Sun.Star Cebu, Dec. 19, 2006, page A9).
To set the record straight, we are furnishing you a copy of a letter sent to the Office of the City Prosecutor of Cagayan de Oro City that is self-explanatory.
Our client, Marcelo Cabahug, purchased the motor vehicle from one Romeo Sanchez on Oct. 9, 2003.
The vehicle had complete papers, including clearances from the Philippine National Police and the Traffic Management Group, certifying that the car is not in the list of carnapped vehicles and that the chassis and engine numbers have not been tampered.
Cabahug sold the motor vehicle to the spouses Olaivar untampered, with the same chassis number, the same engine number and with the same plate number as when he purchased it from Sanchez.
The transfer by Cabahug to the Olaivar spouses was also cleared by the same government agencies and again certified as not among the stolen vehicles and the chassis and engine numbers not tampered.
The spouses Tabada therefore, have no cause or reason to impute estafa and falsification against our client.
Our office is now studying possible legal action against the spouses Tabada for besmirching the good name of Mr. Cabahug.
