Trademarks that have become generic

POWERFUL marks may become so closely associated with the products that they identify and become generic.

A mark that becomes generic is no longer protectable as a trademark since it is now used as the very name of the genus of the goods.

Examples of marks that have become generic are:
Aspirin – acetyl salicylic acid
Zipper – slide fastener
Elevator – lift
Escalator – moving stairs
Thermos – vacuum flask
Cellophane – transparent cellulose sheets
Yoyo – return top
Trampoline – rebound tumbling equipment
Dry Ice – solidified carbon dioxide
One’s marks must be properly used to avoid “genericide.”
