BUSINESSPERSONS take different courses of action when they consider their mark for registration.
Some wait it out until they are confident of the public’s reception of the mark because of fears that the efforts taken and expenses made to register it will be just for nothing if the consumers don’t take the mark well. Others register their mark right away and then do aggressive advertising to support it.
Whether you wait or you register a mark right away is a business decision that can only be made on a case-to-case basis — when all pros and cons for early registration have been considered. Nevertheless, the decision to register a mark must be made at the earliest possible opportunity because our trademark law follows the “first to file rule.”
