Cebu City administrator faces estafa, falsification cases

CEBU City Administrator Francisco “Bimbo” Fernandez is facing cases of estafa, swindling, falsification of public documents, and forgery before the Cebu City Prosecutor’s Office.

Khe Hong Kiao filed the charges against Fernandez after the latter allegedly sold a parcel of land to him without the authority to do so.

In his complaint, Kiao said that sometime in 1991, Fernandez, representing Pagtambayayong, a foundation for Mutual Aid Funds Inc., entered into a memorandum of agreement with him for the sale of a lot located in Barangay Kalunasan, Cebu City.

The lot, said Kiao, has an area of 200 square meters and was valued at P250,000. He added that after paying for the lot in full, he demanded from the foundation, through Fernandez, the execution of a deed of sale transferring the ownership and possession of the lot to him.

“But despite repeated demands, Fernandez failed and refused, and up to the present, fails and refuses to execute (the) contract of sale to transfer the title of the real properties to (Kiao),” his complaint read.

Fernandez said he will face the charges in court, although he pointed out that he is no longer president of Pagtambayayong.

He said they refused to give Kiao the title of the lot because titles are only released to those who will build houses.

“But if he says that he will, then we will release the title,” he said. (KNT)
