Friday, July 27, 2007 CPDO wants road right-of-way strictly enforced in Banilad
THE Cebu City Planning and Development Office (CDPO) has ordered the strict implementation of the 30-meter road-right-of-way (RROW) in the assessment and processing of locational clearance applications for business ventures along Gov. Mariano Cuenco Ave.
This, said City Planning and Development Officer Nigel Paul Villarete, is due to the “present development issues” in the Talamban cluster, which include Banilad, Talamban, San Jose, Budlaan, Pit-os, Pulang-bato and Binaliw.
Upon his recommendation, the executive department expanded the coverage of the moratorium imposed on Banilad to “serve as a brake” of development projects in the north district that contributed to the worsening traffic situation in the area.
Expansion
The moratorium covers both sides of Gov. Cuenco Ave. from the Salinas Drive intersection and up to Binaliw.
In a July 13 memorandum, Villarete quoted City Ordinance No. 1656, or the 1996 Revised Zoning Ordinance, which sets an existing RROW of 20 meters with a provision for expansion of an additional 10 meters.
Before he issued the memorandum to the head of the City’s land use and zoning division, “the customary practice” is to approve applications after the business owner submits an affidavit of undertaking.
The document “binds the owner-applicant to voluntarily demolish, at his own cost, any structure proposed on the planned RROW, at any time the government may already need the land.”
Computation
“No structure may be allowed within the planned RROW for any application of development permit or building permit in the aforementioned area,” the CPDO head said.
Villarete said that the area within the RROW must not be used in the computation of zoning/building setbacks, which should be strictly reckoned from the planned RROW line.
He likewise said that developments in the area should not use the RROW as parking spaces in compliance with building requirements.
“If parking space is adjacent to the road, the space requirement shall start from the line of the planned RROW,” he added.
He said that requests for exemption will be directly referred to the City Mayor’s Office for resolution. (RHM)
