Tuesday, October 30, 2007 Woman sues TMG chief, asks court to release car
A CIVIL case has been filed against the regional chief of the Philippine National Police-Traffic Management Group (PNP-TMG).
Sandra Matiao of Dumaguete City filed a case for recovery of personal property against Supt. Eleuterio Gutierrez and eight operatives of the Traffic Management Office (TMO).
Matiao is asking the court to order the release of her Isuzu Crosswind, which, according to her, was wrongfully seized and impounded.
She filed the case after both oral and written demands upon the defendants went unheeded.
In her complaint, Matiao said operatives of the TMO led by Senior Insp.Sammy Belmonte flagged down her vehicle last Sept. 2 in Dumaguete City for not displaying the 2007 Land Transportation Office sticker.
The vehicle was then impounded for a “macro etching examination.”
Matiao said the vehicle is now in Cebu City under the custody of PNP-TMG headed by Gutierrez after declaring that the engine, chassis and production numbers were tampered with.
But Matiao argued that there was no tampering.
She also told the court that the vehicle is duly registered with the LTO.
Likewise, it has been issued a PNP motor vehicle clearance certificate twice.
