PRO 7 asks ARMM cops to help arrest 'Noy'

THE Police Regional Office (PRO) 7 will coordinate with its counterpart in the Autonomous Region in Muslim Mindanao (Armm) to arrest the alleged Abu Sayyaf member who was caught with explosives on board a Manila-bound ship in Cebu City last August.

PRO 7 Director Ronald Roderos said the move will be made following the order of Regional Trial Court Branch 14 Judge Rafael Yrastorza Sr. who directed the police force in Cebu and Cotabato City to immediately arrest Noy (real name withheld for being a minor).

The accused has jumped bail.

Noy was taken into custody last Aug. 22 when on his way to Manila from Cotabato City on board Superferry 5, which made a stop in Cebu City.

A sack of bananas containing a 90mm recoilless rifle projectile and an M76 rifle grenade was traced to him.

He is out on a P100,000 bail and was last seen during the pre-trial of his case last Sept. 21.

Last week, the court ordered that a warrant of arrest be issued against Noy for his failure to attend the hearing of his case, which is one of the conditions set by the court for his provisional liberty.

Yrastorza also reinstated the original bail of P200,000 for Noy.

Capture

Roderos told reporters that when the regular working days resume on Dec. 26, he will order the Regional Investigation and Detective Management Division to get a copy of the warrant of arrest to the issuing judge for this to be furnished to the Armm police and to the National Bureau of Investigation and the police records section for its database.

Once Noy is captured, the court will hear the motion of Cebu City Prosecutor Rodulph Joseph Carrillo on the determination of Noy’s real age.

The prosecutor earlier argued that Noy was already 19 years old at thetime he committed the crime.

Carrillo presented a copy of the birth certificate of the accused from the National Statistics Office, which states that Noy was born on June 15, 1988.

This is contrary to the document showed by the accused upon his arrest, which states that he was born on June 15, 1990. (JST)
