Cop charged with killing boy, 3

A CASE for reckless imprudence resulting in homicide was filed before the Regional Trial Court (RTC) against the police officer whose .357 Magnum revolver accidentally went off and killed a three-year-old boy last Dec. 28.

PO3 Benjamin “Benjon” Herbias Jr., 44, posted P6,000 as bail after spending the New Year holidays inside the Cebu City Police Office (CCPO) detention cell.

Cebu City Assistant Prosecutor Jesus Feliciano found probable cause to charge the police officer in court. Feliciano conducted the inquest proceedings against Herbias.

“In a negligent and imprudent manner of holding the firearm when he was about to report for work, and without taking the necessary precaution to prevent accident to persons, thereby causing... the said revolver to hit the door of his residence,” read the information filed against Herbias.

According to the initial investigation led by SPO4 Alex Dacua, Herbias, a licensed range officer, was preparing to report for work when his gun accidentally went off inside his rented room on the second floor of a house in Barangay Lorega-San Miguel, Cebu City.

Herbias was about to put his revolver in a pouch tucked in his waistband when his common-law wife Brenda C. Siarez, 34, opened the door from outside. The door reportedly hit Herbias’ hand, causing the policeman to accidentally pull the trigger.

The slug hit Siarez’s lower left leg before it pierced through the wooden floor and hit Shane Kent Bel Lunzaga, who was sleeping on a bamboo bed on the lower level of the house.

Lunzaga, who suffered a gunshot wound in the chest, didn’t make it to the Cebu City Medical Center alive. (KNT)
