ARISTOTLE Aves, the alleged hitman of the Alpha Kappa Rho (Akrho) fraternity is facing a criminal complaint.
But the latest complaint is not fraternity-related.
According to complainant Jesson Navaja Alcantara, 33, the crime appeared to have been commissioned by a relative, Odref Alcantara.
Jesson said he testified against Odref’s family in a land dispute case.
The Office of the Cebu City Prosecutor, however, cleared Odref of any liability, believing instead that Aves acted alone.
“A meticulous evaluation of the evidence on record would show that respondent Aristotle Aves appears to be liable for the offense charged,” the resolution read.
The agency, based on the resolution penned by Assistant City Prosecutor Jesus Feliciano and approved by City Prosecutor Nicolas Sellon, found Odref’s defense
“credible.”
Treatment
Odref, in his counter-affidavit, cited that the complaint against him was filed three months after the incident. He said that he even went to the hospital where Jesson was treated and no one mentioned anything about his alleged involvement in the shooting.
Odref also said the complainant is merely taking advantage of Aves’ reputation of being the number one enemy of the public, adding that Aves is known to use a .45 cal. semi-automatic pistol.
Jesson was shot with a .38 revolver.
“It is not disputed that there is bad blood between the Alcantara family, hence the claim of Odref Alcantara that this case charging him as a conspirator indeed appears to be an after-thought since the police blotter did not include the latter’s name,” Feliciano’s resolution read.
Based on the information submitted to the Regional Trial Court (RTC) Criminal Division, Aves allegedly shot Jesson last Sept. 19.
In the attached affidavits, Jesson said he was hit while driving his multicab along the interior of the subdivision where he lives. He was on his way to the office that time.
Odref, he said, was standing near the main gate of his house, together with his dog.
He claimed to have seen Odref giving a hand signal to a person standing a few meters from him. Shots followed.
He said he got hit on the left arm, chest and foot but still managed to drive away.
Aves and seven others have been facing a murder complaint for the alleged killing of Japanese national Taroh Suda last July 18 in Mandaue City. (KNR)
