A FILIPINA has filed a case against her American boyfriend for abuse, accusing him of nearly beating her to death last May 8.
Julie (real name withheld) filed a case of violation of the Violence Against Women and Children Law or Republic Act (RA) 9262 against her live-in partner David, real name withheld.
The Filipina’s brother filed a grave threats charge against the American.
Julie said David almost beat her to death on May 8, when she confronted him about his pictures with another girl. Julie said their two-year-old son wasn’t spared from the beating.
In her affidavit, Julie said she fainted after David beat her up so badly. She spent two weeks in the hospital. In five of those days, she was in a coma.
She filed a complaint before the police, who arrested David.
During her stay at the hospital, Julie said her maid and her son’s babysitter told her that David brought his mistress, the girl Julie saw on the pictures, to their home in Beverly Hills, Lahug, Cebu City.
Julie said that when she went out of the hospital on May 23, David allegedly tried to kick her and their son out of the house.
Julie sought the help of her brother Andy (real name withheld). It only made matters worse.
“All of a sudden, (David) angrily shouted at me in a loud voice with his fist raised at me, eyes blaring with rage and shouting: you will die big time, I’m going to kill you. He repeated the threats against my life,” read Andy’s affidavit.
Damages
Andy filed a separate complaint for grave threats before the Cebu City Prosecutor’s Office.
Julie, apart from the criminal complaint of VAWC, also filed a separate complaint for damages against David, whom she considered a “husband.”
“Plaintiff clearly has the right to demand for immediate stoppage of the deprivation of her access to the family home, her and her child’s daily support, the threats of violence and serious attempts at their eviction from their family home,” the civil case read.
Julie asked the court to award her half of David’s assets and investments while they were together, a monthly support of not less than P100,000 and another P100,000 in damages and litigation expenses.
Julie also sought for the issuance of a hold departure order and a temporary restraining order against David.
She also wants to upgrade the case she filed into a frustrated murder charge. (JGA)
