Ex-cop files admin raps v. superiors
A DISMISSED cop has accused his superiors of falsifying documents against him.
In a complaint filed before the Cebu City Prosecutor’s office, Marlon Sarmiento, a former PO2 officer, accused Senior Supt. Jesus Gaquing Sr. of falsification of documents and unjust vexation.
Sarmiento and PO1 Sergio Genotivo Jayme Jr. had earlier accused Gaquing of estafa for withholding their paychecks.
The two cops said that instead of receiving their paychecks, Gaquing sent the money to PRH Lending, Inc.
In his defense, Gaquing denied any involvement with PRH Lending. But, he said, there was a notarized promissory note, with a Special Power of Attorney (SPA), that allowed the lending firm to receive paychecks in behalf of a client who owes money.

In a Sun.Star Cebu report, Dr. Joy Hernandez-Cañete, proprietor of PRH Lending, supported Gaquing’s statement, saying that she had never met the police superintendent.
She also claimed that there was a promissory note and an SPA that allowed the firm to claim the cops’ paycheck in their behalf, as they had existing accounts with the firm.
The document was allegedly executed and notarized with an SPA by lawyer Pepito Suello.
But Sarmiento said he never signed in Suello’s notarial register regarding the SPA. He denied having allowed Cañete to collect money from his paycheck and use his ATM card.
Jeoffrey Joaquino, of the Office of Notarial Commission, confirmed the absence of the said SPA.
Joaquino issued a certified true and correct page from Suello’s notarial book, showing that there was no entry confirming the said SPA.
Sarmiento also accused Gaquing of causing him unjust vexation, saying that Gaquing tried to “annoy, irritate, shame, ridicule and disrespect” him for referring to him as “ex-PO2” in affidavits, registered mail and other forms of correspondence.

Sarmiento filed the complaint against Gaquing and PO3 Andy Adlawan Nonong last Friday, July 4. Sarmiento identified Nonong as the finance non-commisioned officer of Regional Mobile Group (RMG), which Gaquing heads.
Nonong was also included the earlier criminal complaints of estafa, filed separately by Sarmiento and Jayme.
In the estafa complaint, Sarmiento and Jayme said Gaquing connived with PRH Lending in allegedly depriving them of their salaries and channeling these to PRH Lending instead.
Cañete clarified, though, that the firm only takes a portion from the whole salary.
Sarmiento was dismissed from service a little after he filed an estafa complaint against Gaquing and Nonong.
The report said Sarmiento had been incurring unauthorized absences since December 29 last year.
Sarmiento, however, denied that such probe had been conducted. He added that the move to dismiss him was mere retaliation on the part of his superiors.
This led him to file an administrative complaint before the National Police Commission, accusing Gaquing and Tabay of dishonesty. (KAB)
