AN ex-soldier and his son were accused of stabbing their neighbor at midnight on July 16.
Rene Duay, 34, of Op-pra, Cebu City, claimed that the father-and-son tandem of Nonoy and Fred (real names withheld because the latter is a minor) went after him a week ago.
Gina Mendez, Duay’s live-in partner, told reporters that Nonoy is a former Philippine Army member while Fred, 17, is reportedly a leader of the Crips gang.
Duay said trouble began after a previous fistfight he won against Nonoy.
In a sworn statement, Duay said that on the night of July 15, Nonoy and Fred came to his doorstep and shouted for him to come out.
Nonoy reportedly threatened to harm him if he would not get out of the house and fight them.
Nevertheless, Duay waited and only went out of the house 30 minutes after they left.
Duay said he went to a store beside a nearby basketball court and ended up drinking beer with a friend.
Drinking
After three glasses, he made his way home a little past midnight. That was when he met Nonoy and Fred along the road.
Fred, who was reportedly with his Crips fellows, allegedly pulled out a knife and stabbed Duay on the left arm.
Duay ran away, but Nonoy and Fred caught up with him and allegedly dragged him along a narrow pathway before Fred stabbed him on the lower back.
Arrest
Duay said Nonoy then hit his face with a handgun, before neighbors arrived and separated them.
PO3 Antonio Den and PO1 Richard Condez of the Mobile Patrol Group also arrived and arrested Nonoy and Fred.
Duay was brought to the Cebu City Medical Center for treatment and was released a day after.
He filed a complaint of frustrated homicide last July 16.
Nonoy and Fred asked for a preliminary investigation, but later asked for an immediate resolution.
Prosecutor Simaco Labata recommended the filing of a criminal charge, but lowered it to attempted homicide because of the nature of the injuries Duay suffered.
“The injuries sustained by the complainant are not fatal; as a matter of fact, he was released from the hospital the following day,” Labata said. (KAB)
