Wednesday, August 20, 2008 Fratman faces charges for rape, kidnapping
A CRIMINAL case was filed yesterday against a “master initiator” of the Alpha Kappa Rho fraternity for the alleged kidnapping and rape of a 15-year old girl Minglanilla, Cebu.
Assistant Provincial Prosecutor Jay Paradiang said Royson Restauro, who “fled from his residence,” will be the subject of a warrant of arrest as soon as the non-bailable case against him is raffled to a trial court.
Restauro’s act of fleeing prompted the filing of the case for kidnapping and serious illegal detention with rape, read the case information submitted to the Regional Trial Court (RTC) Criminal Division.
Royson was impleaded with his father, Rolly, and his wife Mary Jane.
But Paradiang dismissed the complaint against the father and the wife, saying it doesn’t have enough evidence to show they colluded with Restauro in committing the crime.
The kidnapping, based upon Paradiang’s findings and the complaint, happened at around 8 p.m. of Sept. 19 last year.
The victim is a resident of Lawaan III in neighboring Talisay City. She was out on an errand with a friend when both of them were forced unto a waiting motorcycle.
Room
The friend, also a minor, was asked to get off the motorcycle at Fairview Village while the victim was brought to a house in VelPal subdivision in Minglanilla and forced into a room.
“Suspect instructed me to get inside the house… and out of fear, I was forced to get inside,” the victim narrated in the Oct. 3, 2007 sworn statement transcribed by Hazel Rizane-Caballero, of the Minglanilla Police Station.
She said she stayed in the room until she sneaked out at 1 a.m. But the suspect saw her and dragged her back in. She said he was with another person who referred to
the suspect as “brod.”
The following night, the rapes began.
“I was sexually abused again (on the following day) and I felt really tired and helpless and every time I tried to escape, I was prevented by my fears that he might harm my family and myself,” she said.
She was allegedly kept inside the house until Sept. 23 when another person came in and brought her a blank piece of paper and instructed her to sign it in exchange for her release.
“According to the courier, it was the father of the suspect, Rolly Restauro, who instructed him to bring said document for me to sign in exchange for my release,” she said.
She said she signed it and was told she could leave now.
She said she was brought to a gasoline station where the respondent’s father, mother and wife were allegedly present.
She said she was berated by the group before somebody called her sister up to fetch her and bring her home. (KNR)
