Man charged for shooting tanod in front of wife, son in Sudlon I

CITY prosecutors last Friday charged a man for allegedly murdering a Barangay Sudlon I, Cebu City tanod.

They were convinced Hermogenes Nadera, who failed to respond to subpoenas sent against him, was the one who shot dead Fermin Tulib last March 8.

Tulib’s wife Zenaida and their son alleged Nadera was angry after the victim helped authorities in the arrest of the suspect for another crime.

Shooting

According to the affidavits of Zenaida and her 15-year-old son, they and Tulib were walking around 11 p.m. when Nadera suddenly came up and shot Tulib in the chest.

Zenaida said she caught her husband falling and held her to the ground.

She then repeatedly asked Nadera why he shot Tulib, but the suspect just stood still without responding.

Zenaida left the scene to seek help from a barangay councilor, while her son stayed beside his father.

Her son narrated that it was when Zenaida left that Tulib died. Nadera then fled from the area.

Both Zenaida and her son claimed that Nadera had long held a grudge against Tulib who, as a tanod, disarmed Nadera on July 13, 2007 for shooting another relative.

That led to the arrest of Nadela, who allegedly promised to kill Tulib once he gets out of jail.

Drinking

Meanwhile, in Barangay Poblacion, Minglanilla, a drinking session ends in hacking, resulting to the filing of a criminal complaint for homicide.

Warren Secuya was accused of hacking Eric John Lingayo, 20, last Aug. 23.

Responding policemen SPO2 Razul Segismar and PO2 Avelino Selloria stated in a joint affidavit that there was trouble in front of a supermarket at dawn on Aug. 23, involving two groups—that of Secuya’s and Lingayo’s.

Later, that same dawn, Secuya, armed with a bolo, allegedly got back at the group, slashing Lingayo’s head. The latter was rushed to the hospital, but did not survive.

At large

Accounts have it that Secuya was with Ivan Franza during the attack on Lingayo’s group, but he was no longer at his house when police arrived to invite him for questioning.

Lingayo’s companions Leo Francis Lendio, 18; Van Velasco, 29; Bryan Maurio, 24; and the victim’s brother Ernesto Lingayo Jr., 18, submitted separate affidavits narrating the event. It contained the same accounts.

According to the affidavits, Lingayo’s group was drinking at Velasco’s house at Ward 2, Minglanilla. Past 2 a.m., the group was at the highway supposedly to wait for a passenger jeepney. They instead continued drinking alcohol at a nearby store.

Vengeance

After that, they again waited for a jeepney in front of a closed supermarket. This was when Secuya appeared and attacked them. Outnumbered, Secuya ran away when Lingayo’s friends hurled stones at him.

After a while, Secuya and Franza allegedly came back with a bolo and hacked Lingayo.

In a resolution, Assistant Provincial Prosecutor Marvin dela Pena found basis in recommending the filing of a homicide case against Secuya. Since Franza is still at large, he will be facing a separate preliminary investigation on the matter.

A bail of P40,000 was recommended. (KAB/JGA)
