Man, woman face robbery charges
A MAN and a woman are facing charges of robbery before the City Prosecutor's Office for allegedly stealing spare parts for heavy construction equipment worth P12 million.
Charged were Patricia Uy-Leonar alias Elizabeth Uy-Leonar of Ricardo Street, Juna Subdivision, Matina, Davao City, and Jun Saranillos of Jade Avenue, Jade Valley, Diversion Road, Davao City.
The charges stemmed from the complaint of Dennis Juan, a licensed contractor of Double L Construction with office address at Zuellig Avenue, Mandaue reclamation, Cebu City.
In the affidavit-complaint, Juan claimed Double L Engineering entered into a sub-contract with Hanjin Engineering for the construction and building of the Davao International Airport. He said he sent in heavy equipment at the company motor pool in Km. 13, Panacan, to be used for the project.
The complainant also said he hired the services of Pagkakaisa Security Agency to guard the property at the motor pool.
The complainant accused the two of stealing equipment and spare parts from the motorpool amounting to P12 million from February 12-16, 2002 by breaking the padlock.
After evaluating the evidence presented, Prosecutor 11 Lolito Evangelio found probable cause that the crime charged might have been committed.
Senarillos submitted a counter-affidavit and a motion for reconsideration denying all the charges against him as all lies and pure fabrication.
He said that he bought the questioned spare parts and equipments from his co-accused Leonar, live-in partner of his friend.
Senarillos said that in the middle of January 2002, his friend offered him heavy equipment engines, various spare parts and scrap metal ready for disposal. He said he accompanied the two to the motor pool in Panacan and saw the said merchandise.
Since he is in involved in the same business, he showed interest in the deal and asked for the ownership papers before paying. He said Leonar showed him an authorization document.
Senarillos said he was just surprised when the items were not released to him. He said efforts to locate his friend and Leonar proved futile as they disappeared.
Evangelio, however, denied Senarillos' motion for reconsideration for lack of merit in a resolution dated May 12. RCB
