Ombudsman suspends DavOr vice mayor By Raquel C. Bagnol
THE Office of the Ombudsman for Mindanao suspended a Davao Oriental vice mayor for six months and one day without pay for certifying his wife's daily time record even as his wife wasn't reporting for work.
This act is classified as conduct prejudicial to best interest of public service and punishable under the Anti-Graft and Corrupt Practices Act.
In a 10-page resolution, graft investigation officer 1 Noel Q. Gelito found substantial evidence to hold Jose Learto M. Otig, vice mayor of Banaybanay town, guilty of the administrative offense charge.
Otig was charged for verifying and certifying the Daily Time Record (DTR) of his wife, Rosenie U. Otig even as he was aware his wife never reported regularly at the office of the Municipal Council of Banaybanay where she was assigned as utility aid.
The complainants Petra Japos, Albert Abela and Nilda Abos, all residents of Poblacion, Banaybanay alleged that Rosenie Otig, who was appointed as one of the utility aides for a project funded by the provincial government of Davao Oriental, accomplished her monthly DTR's for the months of April, May and June 2000 duly verified by Otig.
Otig in his counter-affidavit said that Rosenie was employed by the provincial government of Davao Oriental as a contractual worker or job order worker placed under his supervision.
He said his wife's job does not require her to report to his office and had already stopped working with the government since July 1, 2000. His wife also conducted regular visits to various barangays of Banaybanay.
But the complainants were able to establish that Rosenie did not regularly visit different barangays to conduct field works and during those times, she also did not report for work at the SB, her official workstation.
During the preliminary conference, only the complainants and Otig showed up, saying that Rosenie was already in the US.
The Ombudsman found that Otig could not raise the defense that his verification of the DTRs is only ministerial. He was the direct supervisor of his wife and no other persons monitored the attendance of the latter.
