Aussie sues mayor for bouncing checks

AN AUSTRALIAN national filed charges for five counts of estafa against a mayor of Davao del Sur for allegedly issuing five checks amounting to P607,500 that were dishonored by the bank because the account was already closed.

Facing formal charges before the Regional Trial Court is Alex Wangkay, mayor of Jose Abad Santos, Davao del Sur. The charges stemmed from the complaint lodged by Anthony George Stanbridge of 109 Lancer Street, Executive Village, Matina, Davao City.

In his complaint, Stanbridge alleged that Wangkay issued the following Metrobank checks in his favor: No. 0174904 dated November 20, 2001 for the amount of P200,000; No. 0174905 dated December 20, 2001 for P105,000; No. 0174920 dated January 10, 2002 for P200,000; No. 0174918 dated January 20, 2002 for P52,500; and No. 0174937 dated February 1,2002 for P50,000, or a total of P607,500.

Stanbridge claimed that the Metrobank dishonored the five checks and Wangkay failed to make good the checks even after repeated demands.

Stanbridge also claimed that Wangkay issued the checks to him as payment for obligations during the mayoral elections last May 2001.

A final demand notice was sent to Wangkay on March 6.

Stanbridge is demanding a payment of all the checks from Wangkay, an additional P125,000 that Wangkay borrowed from him, and ten percent of the sum of the checks for attorney's fees, plus a 12 percent interest per annum from the time the checks became due.

In his resolution, Prosecutor Efren B. Cachuela held that the respondent's issuance of the checks in exchange for monetary value when he knew that his account with the bank was closed constitute deceit and Cachuela recommended the filing of information before the court. RCB
