City to stop fishpond operation in Malabog

BUSINESS Bureau Chief Erwin Alparaque said Thursday the City Government would issue a cease and desist order on the operation of a fishpond registered under one Eleonor Caporoso beside Lake Macaduhong in Barangay Malabog for failure to renew the business permit since 1999.

In an ocular inspection conducted last Saturday by City Councilor Beethoven Orcullo, chair of the City Council Committee on Environment, it was found that the land, which the Caparosos claim as their property encroaches on a protected area beside Lake Macaduhong.

Alparaque said that if there were environmental violations, then they would immediately cancel the permit as soon as recommendations by the City Environment and Natural Resources Office (Cenro) will be served in their office.

He added that there are regulatory officers from Cenro and City Health Office who will conduct inspection, and that if they pass, it will be approved. But since their permit was since 1999, the business bureau can issue a cease and desist order on its operation.

Agapito Caparoso, husband of Eleonor, admitted they do not have a title certificate on the lot. But he said he would not give it up because of sentimental reasons.

"There was an admission on the part of Caparoso that he does not have a title for the land and that it is government property. Actually, the land is an excess of the lot he used to own that he has already sold. But this excess lot is now on a watershed area," Orcullo said.

Orcullo said Caparoso could be charged with violation of Forestry Code.

He said the barangay already filed a complaint together with the Department of Environment and Natural Resources (DENR), but this has not been acted upon. AAG
