Tic Tac Toe 'winners' to seek court's ruling

MORE than half of at least 100 Dabawenyos who claimed to have won in the Tic Tac Toe promo of ABS-CBN are satisfied with the media giant's explanation why it will not pay the supposed amount won.

But some 20 "winners" will seek a ruling of the court on the refusal of the broadcast company's management to honor their "winning cards" for the eighth week of the promo, ending July 27, Sunday.

The cards could have allowed them to divide the P1 million weekly jackpot.

Participants of the promo are asked to buy Safeguard, Pantene, Head and Shoulders, San Miguel Beer and Pista Pansit Ulam products and exchange their wrappers or crowns with game cards with different combinations.

If the player happens to possess the winning logo combination, and the show where the logos were flashed, he/ she is entitled to a prize.

Sheryl Lyn Longakit and other "winners" in the city met with Roderick Resurrecion, ABS CBN Manila's marketing manager last Wednesday, for a mediation meeting before the Bureau of Food and Drugs (Bfad) office.

It was learned that because Dolphy celebrated his birthday special last July 27, his show Home Along the Riles, instead of lasting only for an hour, was extended to three hours.

Winners claim it was during the Home Along the Riles slot, around 9:15 p.m. that the logo appeared.

Resureccion, in Wednesday's meeting, however denied the logo's appearance during the Home Along slot, according to Department of Health (DOH) 11 Acting Consumer Arbitration Officer Gil Cawad in an interview last Thursday.

Cawad said Resurrecion told participants in Thursday's meeting that the logo appeared during the Sunday Family Cinema slot, which follows Dolphy's show.

He explained that the management was able to issue an advisory issuing the correction, Cawad added.

Longakit, in Thursday's interview, said that when they pressed the media giant to show the footage of birthday special where the logo and the advisory was supposed to have appeared, the company initially refused, because Resureccion said "they do not record their shows on tape".

"Pero sa among pagmeeting kagahapon (Wednesday) sa Bfad (in Davao), ilang gipakita. Pero gilahi nila kay ang tinood nga nugawas una, ang logo, human ang advisory dayon. Dili na man to mao kay ang gipakita kagahapon sa amo nauna na man ang advisory bag-o ang logo," she said.

She said that ABS CBN bought the tape from AC Nielsen, a company engaged in broadcast internship and viewership surveys.

While more than half of the promo winners were appeased with the ABS CBN official's explanation, Longakit and more than 20 of her companions decided to forward their case to the court.

Longakit Thursday said they have talked with the lawyer from the Public Attorney's Office (PAO) who advised them to file their statements for the issuance of affidavit of complaint.
