Woman jailed for life appeals court decision

THE first woman to be meted life imprisonment for selling shabu since the implementation of Republic Act 9165 or the Comprehensive Dangerous Drugs Act in July 2000 filed an amended motion for reconsideration before the Regional Trial Court (RTC).

Aminah Bucay, 22, of 23-C Mini-forest, Boulevard, Davao City, filed her motion for reconsideration before the sala of Regional Trial Court (RTC) Branch 9 Judge Adoracion Avisado.

Avisado earlier convicted Bucay to life imprisonment and fined her P5 million in a decision dated August 1.

Bucay was arrested by elements of the Heinous Crimes Investigation Section (HCIS) of the Davao City Police Office (DCPO) in December 16, 2002, through a search warrant issued by former RTC Executive Judge Virginia Europa.

Court records show that PO1 Enrique Ayao, who was tasked as a poseur-buyer, went to the house of one Alma Angani with a civilian informant but instead of Angani, Bucay was there.

Ayao pretended to buy P300 worth of shabu from Bucay.

Bucay went inside a room and came out with a sachet of shabu weighing .0939 grams. When Bucay handed him the sachet of shabu, Ayao identified himself and arrested Bucay.

Further search led to the confiscation of 16 more sachets of shabu, various shabu paraphernalia and a Nokia 3210 cellphone.

Bucay denied the charges in court. She claimed she was just at the house of Angani to recharge her cellphone because there was no power outlet in her house.

She alleged she was surprised when policemen came in and arrested her without apparent reason.

Bucay only escaped the death penalty due to the absence of a test kit at the time she was arrested. No urine test was conducted on her, therefore the court found no qualifying aggravating circumstances to the charges. RCB
