Man sued for beating 2 minors

AN AGRICULTURAL company executive is facing charges before the Regional Trial Court in Davao City for allegedly beating two minors with a wooden stick, commonly called baton, several times causing injuries to the victims.

Charged with slight physical injuries, a violation of Article 266 of the Revised Penal Code, is Tani Wenceslao of 119 4th-A Street, Ecoland Subdivision, Davao City, who works with Dupont Philippines.

The complaint was filed by 11-year-old Jojo (not his real name), a Grade 4 pupil of Aurora-Quezon Street, Davao City.

In his affidavit, Jojo claimed at around 1 p.m. on March 16, he and his friend Manny (not his real name) were playing at a basketball court near Wenceslao's house.

He claimed when they saw guavas near Wenceslao's gate, Manny allegedly went inside to ask permission to get guavas.

When Manny did not come out after a while, Jojo decided to follow his friend inside.

Jojo claimed Wenceslao's helper saw him and accused him of stealing an electrical hose.

Jojo claimed he and Manny were detained inside Wenceslao's house where they were beaten black and blue by the respondent using the "baton".

Jojo claimed his tooth was extracted when Wenceslao allegedly hit his face with the 'baton'. This caused him so much pain, Jojo said.

In his counter affidavit, Wenceslao denied beating the two boys and insisted that he merely scolded them for stealing his hose. He claimed this case was filed as a counter suit against him because he filed theft charges against the two minors pending before RTC branch 8.

Wenceslao's helper Rey Napatutan executed an affidavit and supported Wenceslao's claim the boys were not beaten but merely scolded.

Fourth assistant city prosecutor Manuel M. Batao recommended the filing of charges against Wenceslao before the family courts of the RTC since Jojo is a minor.
