Online trademark, patent applications in 2004: IPO

COMPANIES and business establishments outside Metro Manila may soon apply for trademark and patent rights and protection online, documentation, information and technology transfer, Bureau Chief Carmen Peralta of the Intellectual Property Office (IPO) announced on Tuesday.

"All the systems are in place already and we are just fine-tuning the program," she told participants of the IP Rights roundtable discussion at the Grand Regal Hotel.

Peralta said the automated application serves as an answer to the clamor of businessmen and inventors in various areas of the country who are burdened with high costs in applying for trademark and patent rights.

Davao City-based inventor Virgilio Sangutan, in an earlier forum said at least P20,000 is needed to pay a lawyer to defend the application for an invention patent, excluding the transporation and lodging expenses.

Peralta said the mark is any visible sign capable of distinguishing the goods (trademark) or services (service mark) of an enterprise and shall include a stamped or marked container of goods.

The IPO presently maintains a website, http:/ipophil.gov.ph, which offers access to searchable Philippine Trademark database, downloadable information such as the IP Code, an regular IP news, among others.

Other IP rights covered are copyright and related rights, trademarks and service marks, geographical indications, industrial designs, patents, lay out designs of intergated circuits, and protection of undisclosed information such as "trade secrets" of a company.

The roundtable discussion is the final leg of the IP campaign caravan for this year, which kicked off in Iloilo City on June 20.
