Sales agent sued for non-remittance of P2.1M By Raquel C. Bagnol
A LADY employee of a publishing company has been charged with estafa for allegedly failing to remit collections for assorted school textbooks amounting to P2,125,335.
Chief City Prosecutor Raul Bendigo forwarded the charges filed by Alexander Cruz, operations manager of Phoenix Publishing House (PPH) against Marievic Latada based on a resolution by prosecutor Efren Cachuela.
In his complaint, Cruz said Latada was authorized to deliver books and collect payment from schools in regions 11 and 12 for school year 2002-2003, however, Latada allegedly admitted she had already collected the said amount, but misappropriated it for personal use.
Used as evidence was Latada's letter to Erlinda Sibal, PPH president.
In her letter dated July 20, Latada apologized to Sibal for misappropriating the money, claiming that poverty prompted her to do it.
She admitted she had already collected the receivables from the schools although there were no collections reported to the office.
Further examination of records showed Latada tampered with provisional receipts. She also interchanged stocks for deliveries and sold promotional items.
Cachuela ruled that although there was no demand letter sent by PPH, Latada's letter, admitting what she had done, is enough evidence of the probable existence of guilt.
Cachuela recommended a P40,000 bailbond for Latada's provisional liberty.
