Policeman sued over pigpen
THE City Prosecutor's Office (CPO) formally charged a police officer before the Municipal Trial Court in Cities (MTCC) with violation of the sanitation code for allegedly raising nine pigs inside an odorous pigpen beside a school -- disturbed a community in Calinan, Davao City since 2002.
Assistant chief city prosecutor Danilo Belo forwarded the charges against SPO3 Ronald Lapitan, of the Mintal police precinct, before the MTCC for allegedly violating Section 85 of Chapter 19 of Presidential Decree 856 (Code of Sanitation of the Philippines) based on the resolution penned by prosecutor Emilio Dayanghirang III.
Dayanghirang resolved the case based on the complaint filed by Sister Donatila Cruz, directress of Holy Cross College Calinan (HCCC) who was one of those directly affected by the foul odor and noise coming from Lapitan's pigpen.
In her complaint affidavit, Cruz, of the Presentation of Mary (PM) Sisters, claimed the unsanitary condition and the noise of the pigs coming from Lapitan's pigpen caused them great discomfort as they are staying in a convent within HCCC premises.
Cruz added that the City Health Office (CHO) satellite office in Calinan earlier confirmed that Lapitan's pigpen has badly affected the health conditions of the people in the area.
Cruz added that Lapitan did not heed written and oral demands of the CHO prompting her to file the complaint before the CPO. RCB
