Man gets 14 years for trader's slay
THE Regional Trial Court (RTC) sentenced a man to a maximum of 14 years imprisonment for stabbing to death a livestock trader in Tugbok District, Davao City in January last year.
RTC 33 Judge Wenceslao Ibabao on Wednesday convicted Felecisimo Erispe, of Km. 20, Barangay Los Amigos, Tugbok District, Davao City after the court found him guilty of stabbing Esperidion Platan, of Talipapa, Barangay Sto. Niño, Tugbok District.
Murder charges have been originally filed against Erispe before the City Prosecution Office (CPO), but Erispe plea-bargained for a lesser offense of homicide before the court thorugh the assistance of his counsel Lope Calio.
The prosecution offered no objection to the plea-bargaining agreement.
Testimonies of the witnesses in court showed that at around 9 p.m. on Jan. 26, 2003, Platan was having a drinking spree with his friends inside a "carinderia" in Los Amigos when Erispe and his son, identified as alias Toto, arrived.
Toto punched Platan on the face which caused him to fall. Erispe then drew out a knife from his waist and stabbed Platan several times in different parts of the body.
Platan's friends tried to pacify the fight but failed. They brought Platan to the hospital but he succumbed to seven stab wounds.
Only Erispe was convicted by the court because alias Toto is still at large.
Ibabao also ordered Erispe to pay Platan's widow P50,000 plus another P25,000 for damages. RCB
