SC junks suit questioning canvassing rules
THE Supreme Court (SC) voted unanimously Tuesday to dismiss a suit questioning the canvassing rules adopted by Congress saying the legislative branch did not abuse its discretion in approving such rules.
By a vote of 14-0, the High Tribunal also said the canvassing is an internal matter in Congress that the court cannot interfere in.
Opposition Rep. Ruy Elias Lopez of the third district of Davao City filed the suit.
The SC earlier rejected Lopez's plea for a restraining order on the canvassing.
In reaction to the SC ruling, Lopez said in an interview over ANC channel that he was disappointed of the decision junking his petition to nullify the rules of canvassing adopted by Congress.
"If that is the decision of the Supreme Court, then I am disappointed because I am prevented to exercise my duty. The people in third district (of Davao City) are deprived from participating in knowing who really won in the recent elections," Lopez said.
Lopez said he will file a motion for reconsideration to the Supreme Court.
"What I am only asking them is to allow my representation in the canvassing as it is supposed to be my right to participate," Lopez said.
Lopez said the decision of the SC against his petition is also a way of depriving the other 215 congressmen from exercising their constitutional duty.
Lopez said the SC ruling only set the precedent that a certain duty of congressman can be prevented just because there is a majority who would wish to waste other congressmen's right to exercise their duty.
