Writ of habeas corpus vs TFD, Army to be decided Monday

THE court will come up with its decision on Monday regarding the petition for a writ of habeas corpus filed by the sister of suspected rebel leader Eduardo Ramos alias Ka Pipoy who is now in the custody of the Army's 73rd Infantry Battalion.

In a telephone interview Friday afternoon, Karapatan Southern Mindanao Secretary General Ariel Casilao said the court heard both parties in Friday's hearing before the sala of Judge Emanuel Carpio of the Regional Trial Court branch 16.

Ka Pipoy's sister, Lucita Duldula, filed the writ of habeas corpus after Task Force Davao (TFD) and the Army's 73rd Infantry Battalion based in Malagos,
Baguio District allegedly arrested her brother illegally on September 16.

Legal counsel for the complainant Napoleon Sango reportedly moved for the commitment of Ka Pipoy to the proper authorities aside from the military.

In Friday's hearing, however, Ka Pipoy explicitly told the court that he preferred to stay in the custody of 73rd IB.

Counsel for the Army's 73rd IB requested the court for the Army to take custody of the captured rebel.

Casilao said both sides had presented their arguments and it is up to the court now to decide on the merits.

Ka Pipoy is in the custody of the Army's 73rd Infantry Battalion. Lt. Col. Erick Parayno, chief of 73rd Infantry Battalion, confirmed this.

Parayno said Ka Pipoy is still undergoing "custodial debriefing" and would remain inside their camp until the process is over.

Early this week, relatives of Ka Pipoy accompanied by members of human rights group Karapatan tried to visit the rebel leader at the Army camp but were prevented by the soldiers, saying the suspect was already turned over to Task Force Davao.

"Ka Pipoy" was arrested by Army soldiers at his temporary residence in Purok 5, sitio Malitbog, Barangay Nanyo in Panabo City at around 4 P.M. on September 16 by virtue of a warrant of arrest for a string of atrocities against civilians in Marilog and Paquibato districts.

He is facing robbery in band charges, among others.
