Court orders arrest of man in dollar raps for contempt

FOR failure to appear before a scheduled arraignment Friday, a man who was accused of possessing guns without proper documents and fake US notes was ordered arrested and asked to explain why he did not show up.

Judge Emmanuel C. Carpio of the Regional Trial Court Branch 16 issued the warrant of arrest against Jose Agbayani Jr. alias "Peping" of Aquino Subdivision in Agdao, Davao City. Carpio also ordered the forfeiture 8 of Agbayani's P24,000 bailbond for his provisional liberty.

Agbayani was charged with violation of Article 168 of the Revised Penal Code (RPC) for illegal possession of firearms and fake US dollars.

Court records show the Regional Criminal Investigation and Detection Unit 11 (RCIDU), armed with a search warrant issued by Executive Judge Paul T. Arcangel, conducted a search on Agbayani's house at 1:45 p.m. on March 18.

Barangay officials witnessed the search, led by Senior Police Officer 2 Marcial Gabonada and Police Officer 3 Nephtali Dionela.

In their joint affidavit, the policemen claimed they saw Agbayani and two other men scanning machine copies of 100 US dollar bills. The two also said they saw several foreign currencies on the table.

Upon entering Agbayani's bedroom, Gabonada and Dionela said they saw the caliber .22 pistols and other questionable items.

Authorities also seized five magazines and 230 pieces of live ammunition, three pieces gold-coated metal and 85 pieces 100,000 US dollar gold certificates.

The authorities believed that Agbayani's two visitors conspired with him in selling fake gold bars and counterfeit US dollars.

Agbayani also failed to present necessary documents for the two guns.
