Lawyer meted 5-year jail term for not sending recruit abroad
FOR collecting P45,000 from an electrician whom he recruited for work but failed to deploy him to South Korea 10 years ago, a Davao City lawyer was convicted to five years imprisonment.
In a five-page decision, Judge Jesus V. Quitain of the Regional Trial Court (RTC) Branch 15 convicted lawyer Macario Solis Jr. to five years and also ordered him to pay the complainant P45,000 plus interests.
Norberto Evangelio of Davao City filed the complaint.
Evangelio claimed that sometime in May 1994, he went to Milestone Manpower agency to apply and train as a factory worker in South Korea and was lured with the promise of a $500 monthly salary. He said he paid P45,000 to Solis as placement fee. He said he was just one of the 300 persons recruited.
He added that on June 6, 1994, he went to Manila supposedly to process his papers and other documents but the accused failed to deploy him to South Korea.
Solis, however, denied receiving P45,000 from Evangelio and said he only received P15,000 from him.
The complainant allegedly failed to leave for South Korea because the Korean company denied their employment for failure to pay the company share of the processing fee.
Solis said he cannot return the amount to Evangelio because the president of the Manila-based Milestone Manpower went into hiding.
Solis claimed they were legitimate recruiters for jobs abroad but their license had expired. He added that during the time he recruited Evangelio and the 299 others, their contracts were still being processed.
After sifting through all the evidence presented, the court ruled in favor of the complainant. (RCB)
