Chinese trader sued for smoking in store By Raquel C. Bagnol
RULES are rules and foreigners are not exempted. This proved true after a 38-year-old Chinese trader in Davao City was arrested for smoking a cigarette inside his store.
For this, the Chinese trader is facing charges before the Municipal Trial Court in Cities (MTCC) Branch 2.
In her one-page resolution, assistant City Prosecutor Arlene Palabrica recommended the filing of charges for violation of the Republic Act 9211 or the Tobacco Regulation Act of 2003 against Shi Zongwu, native of Fujian, China and owner of DCLA Merchandise store along Magsaysay Avenue.
The complaint was filed by Police Officer 2 Edwin Locostales of Santa Ana Police precinct.
In his affidavit, Locostales said he and another policeman were conducting foot patrol along Magsaysay Avenue when he spotted Zongwu smoking a cigarette inside his establishment at around 10:50 a.m. of January 10. Locostales said the establishment was a closed area.
He said he arrested Zongwu and was able to confiscate a partially consumed stick of an imported Hongnel brand of cigarette.
