Assistant city prosecutor Serafica Justiniani-Weis recommended the filing of charges against the two respondents based on the complaint filed by Sarmil Janea, resident of Doņa Pilar Village, Sasa, Davao City, reporter of ABS-CBN and dxAB, and his companion identified as James Larida of Bangkal, Davao City.

In their separate affidavits, Janea and Larida claimed they were waiting for a taxicab outside the Rizal Promenade at around 1:30 a.m. on April 1 when Gepte confronted them. Janea alleged Gepte pointed a gun at him and Larida. He added that Gepte's companion came and hit him on his face.

Janea said the two suspects then boarded a multicab and fled from the scene. Janea said he immediately sought police assistance that led to the eventual arrest and detention of Gepte, whose companion is still at large.

It was also established that Gepte only pointed the gun at the complainants while it was his companion who inflicted physical harm on Janea and Larida.

Weis recommended a bail bond of P1,500 for the temporary freedom of each of respondent.
