Chromite shipment legal: mines bureau

THE Mines and GeoSciences Bureau (MGB) 11 declared Monday as legal the shipment of 1,200 metric tons of chromite, being covered by an ore transport permit issued by the Provincial Government of Davao Oriental.

In a telephone interview Monday, MGB-11 Director Maria Luisa Jacinto said the Municipal Government of Governor Generoso could not hold the transport of the chromite placed at around P3.3 million since the shipment is covered by legal papers.

Jacinto however added they are not dismissing outright the request of Mayor Jerry dela Cerna. She said this is the main reason why they recommended to Governor Maria Elena Palma Gil to notify the Davao-Luzon Minerals Company Limited (earlier reported as Davao Loyalty Mining Corporation) about Mayor dela Cerna's complaint.

Jacinto said investigation on the matter would now be handled by the Provincial Government since issuance of small-scale mining permits had been devolved to the local government.

"Ang Provincial Government na ang magde-determine ngayon sa legality ng operation ng mining corporation.

In the meantime papayagan munang magpatuloy ang mining operation doon kasi may legal papers naman sila," Jacinto said.

Dela Cerna earlier protested the transport of the chromite saying the barge left the municipality without clearance from the local government.

In a telephone interview, dela Cerna's private secretary Alexander O. Cadiena Jr. told Sun.Star that the policemen detailed at Barangay Magdug were helpless when the barge pulled out of the shore last Friday.

Cadiena said dela Cerna has filed a legal action against the coast guards for not intervening in the barge's departure despite knowing that the said chromite cargo was in question.

Dela Cerna expressed disappointment for the alleged failure of the Department of Environment and Natural Resources (DENR) because the activities of DMLC have gone unchecked.

He added a possible connivance existed between the miners and some personnel of the DENR. The MGB denied any anomaly in the mining operation there.
