Supreme court rules v. village chief

BARANGAY Chair Roberto E. Olanolan of 76-A, Bucana, Davao City said he has no plans yet of stepping down from his post despite the decision by the Supreme Court (SC) dismissing his petition against the Commission on Elections (Comelec) that earlier announced Celso A. Tizon as the winner.

In a telephone interview Tuesday, Olanolan said he has not yet received the SC order dismissing his petition.

Earlier, Olanolan filed a petition at the SC to nullify and set aside the Comelec en banc resolution denying his motion for reconsideration of the Comelec's Second Division resolution declaring Tizon as the duly elected chairman of Barangay 76-A, Bucana.

It can be recalled that Olanolan stepped down from his post as barangay captain on September 21, 2004 to give way to Tizon following the en banc's resolution.

However, on November 9, 2004, the SC en banc directed the parties to observe the status quo prevailing before the issuance of the assailed resolution and order of the Comelec.

Thus, Olanolan was reinstated as chairman of Barangay 76-A on December 6.

"Wala ko'y nadawat nga order from the Supreme Court bahin sa dismissal sa petition nako (I have not received the order from the Supreme Court about the dismissal of my petition)," Olanolan said, adding that he will continue to head the barangay until the SC furnish him the order.

City Interior and Local Government chief Merilo Limbaro, meanwhile, said their office has not received the same order from the SC.

"Even the regional office does not yet have a copy of the order. We will await the instructions. Depende na kung kinsa nga agency ang mo-execute sa order," Limbaro said.
