Village justice members sue Olanolan for graft
FOUR former Lupong Tagapamayapa members of Barangay 76-A, Bucana, Davao City filed a case with the Office of the Ombudsman Mindanao against Robert Olanolan and two other barangay officials for violation of Republic Act (RA) 3019 or the Anti-graft and Corrupt Practices Act.
The complainants, which include Jose Samalca, Ruperto Solon, Pedro Maamo and Paulino Culanag, bared in their affidavit of complaint, copy of which was obtained by Sun.Star, that Olanolan had instructed barangay bookkeeper Rommel Marasigan to hold the release of their honorarium after December of 2004.
"Marasigan told us and even promised that we will be able to receive the December 2004 honorarium. However, on April 7, we also discovered that our names were excluded already in the payroll since December 2004. There was unity of purpose and unity in the execution of the unlawful objective among Barangay Captain Olanolan, Marasigan and barangay treasurer Jocelyn Sonza to exclude us in the payroll," the complainants stated.
The complainants claimed they have not received any notice of termination or withdrawal of appointment from Olanolan.
"Such unilateral move in deleting our names in the payroll for the Lupong Tagapamayapa is a mode of termination without due notice and proper hearing in violation of Sections 4 and 7 of Rule IV paragraph C of RA 7160 or the Local Government Code.
The complainants pointed out that Section 4 states "Lupon members shall hold office until a new Lupon is constituted on the third year following their appointments, unless the term of any of the Lupon member is sooner terminated by resignation, transfer of residence or withdrawal of appointment by Punong Barangay with the concurrence of the majority of all members of the Lupon."
Thus, Section 7 states "after proper notice and hearing, the Punong Barangay may withdraw the appointment of a Lupon member with the concurrence of a majority of all Lupon members."
In this regard, Olanolan said that majority of the 20 Lupon Tagapamayapa of the barangay concurred to exclude the complainants.
Olanolan said he is ready to answer the charges against him believing he has not violated the law on the matter. (AAG)
