2 soldiers charged with grave threats By Raquel C. Bagnol
A DAVAO City policeman filed charges against two members of the Philippine Army whom he accused of poking at gun at him and threatening to kill him in Mintal, Davao City five months ago.
Facing charges of grave threats or violation of Article 282 of the Revised Penal Code (RPC) before the Municipal Trial Court in Cities (MTCC) are second Lieutenant Aris Cuaton and Sergeant Arlendo Mingueto of the Army's 55th Engineering Brigade, based on the resolution penned by assistant city prosecutor Augusto Gonzales.
Senior Police Officer 3 Rogelio Ico of the Mintal Police Precinct lodged the complaint against the two respondents before the City Prosecutor's Office.
In his complaint affidavit, Ico said he and another policeman went to Barangay New Loon in Mintal at around 5:25 p.m. of January 10 after they received information that somebody allegedly fired a gun.
Ico said that when they investigated, Cuaton allegedly got angry and poked a gun at him. He said he tried to arrest Cuaton but the latter allegedly left the area on board a motorcycle.
Mingueto, whom Ico alleged as drunk, also poked a gun at him, too. Ico said he and his companion were able to arrest Mingueto and took him to his commanding officer.
