9 rebels ordered arrested for murder By Raquel C. Bagnol
THE Regional Trial Court (RTC) has ordered the arrest of nine alleged members of the New People's Army (NPA) who were accused of shooting to death a man and his son in Paquibato, Davao City in March 2004.
RTC Branch 11 Judge Virginia Hofileña-Europa issued the warrant of arrest on May 20 against one alias Titing and alias Tingting, both of Paquibato, and Guillermo Lodres alias Ka Benjie, Ka Manny, Ka Bobong, Ka Gerom, Ka Pakaging, Ka Geo and Ka Rey, all suspected NPA members. All suspects are facing double murder charges.
Assistant City Prosecutor Arlene Palabrica, in a resolution dated April 15, recommended the filing of non-bailable double murder charges against all the accused.
Palabrica resolved the case based on the evidences presented by the complainants because there was no return of service of the notification to the respondents, as they have no permanent and clear addresses.
Jhundy Paubsanon filed an affidavit and claimed that around 10 to 12 NPA members visited them at their house at around 9:54 a.m. on March 29, 2004 and talked to his father, Jesus, 54, and brother, Allan Butch, 24.
He claimed that after a few minutes, the rebels fired their guns at his father and brother, killing them on the spot. Jhundy's mother also filed a separate affidavit to support his claims.
