4 Indonesians charged for duping Pinoy firm

FOUR Indonesian nationals are facing charges of estafa before the Regional Trial Court (RTC) after they were accused of duping a business establishment of P1.6 million supposed to be for payment of the supply of diesel oil in October last year.

Charged with violation of Article 315 of the Revised Penal Code before the sala of Judge Emmanuel C. Carpio of the RTC Branch 16 were Jootje Pinontuan, Deetje Poluakan, Christian and Delfian Pinontuan, all of Ecoland Subdivision in Matina, Davao City.

Assistant City Prosecutor Emilio Dayanghirang earlier recommended the filing of charges against the respondents after finding probable cause to hold them for court trial based on the evidences presented by the complainant, lawyer Elvin Hayes Nidea of Makati City.

In an eight-page affidavit, Nidea said he is the legal counsel of Andan Enterprise and O'relyn Trading Corporation.

He claimed his partner Dale Pastoriza of Davao City informed him in October 11 last year that an Indonesian firm represented by Jootjie Pinontuan has offered to supply them with hi-speed diesel oil in large quantities. He said they told the respondents they were interested in the offer.

Nidea was later appointed counsel of the PT Jaya Bumi Lestari, the alleged company of the respondents.

He said he and Pastoriza went to Manado in November last year to finalize the deal.

Nidea claimed that aside from the various expenses they incurred in going to Manado, they also spent thousands for telephone communications and processing of documents.

He said they paid US$30,000 for the diesel oil and its transport via cargo ship but no diesel oil was delivered.

He also added that the respondents did not return the money despite several electronic demand letters, which eventually prompted them to file the case in court.

A bailbond of P40,000 each was recommended for the temporary liberty of the respondents.
