Magna Carta for students pushed

COUNCILOR Angela Librado-Trinidad Tuesday pushed for the enactment of a Magna Carta for students' rights following the refusal of a nursing school here to enroll a student, who has a photograph of herself showing her cleavage.

Trinidad said the photograph led to unjust insinuation that the student engages in prostitution to finance her schooling.

Trinidad refused to name the school and the student, who is supposedly in her fourth year.

"When a student is denied enrollment in an institution of higher learning due to an imposition of a penalty imposed by the school, the clash between the academic freedom of the student and the institution becomes inevitable. While it is difficult to conclude which right is preferred, the interests must be balanced carefully in order to protect the freedom for which it should rightfully be given under the circumstances," Trinidad said.

Trinidad said the penalty imposed by the school against the student was not commensurate considering that it was reached after unjust accusation and false conclusion that the student engaged in prostitution activities for her tuition.

Trinidad believes it is unfair that the summary imposition of penalty was reached even without conducting a thorough investigation to determine with a degree of reasonable certainty that the student really engaged in prostitution.

Trinidad said the case of the student was already filed in court.

"It is an opportune time that we enact a Magna Carta for students' rights applicable to Davao City. As legislators, we owe it to the students whose aspirations for a better future lie with education that they have the protection from possible violations of their academic freedom committed by the school's authorities," Trinidad said.
