Judge junks Olanolan's reconsideration motion
REGIONAL Trial Court (RTC) Judge Emmanuel Carpio of Branch 16 had denied last week the motion for reconsideration filed by Robert Olanolan, who is contesting the barangay chairmanship of Barangay 76-A, for the dismissal of the civil case filed by the latter against three City Hall officials.
Olanolan filed the motion for reconsideration on September 12 after Carpio dismissed the civil case he filed against City Administrator Wendel Avisado, City legal Officer Melchor Quitain and City Accountant Rizalina Justol.
Olanolan sued the three for refusing to release funds to his office depriving his staff of their wages and honoraria since April this year.
City Hall has been adamant in saying that Olanolan is no longer the legal barangay captain of 76-A following a Supreme Court resolution stating that the legitimate barangay captain is Celso Tizon.
Olanolan has been contesting this and has been saying he never received such resolution.
The City Hall was also not budged from its stance even after the barangay council passed a resolution requesting Regional Director Rodolfo Razul of the Department of Interior and Local Government (DILG) 11 to issue request addressed to City Mayor Rodrigo R. Duterte, Avisado, Quitain and Justol to release government funds to him.
In denying the motion for reconsideration, Carpio noted that the DILG has not confirmed the release of funds in favor of Olanolan while the City Hall officials already submitted a comment to the motion on September 19. In view of this, Carpio denied the motion last September 22. (JGR)
