Raps filed v. man for raping niece

CHARGES of rape have been filed against a 35-year-old man accused of sexually molesting his eight-year-old niece while the latter was sleeping at home in Barangay Ma-a, Davao City, January this year.

Prosecutor I Stella Camino, who recommended the filing of charges, did not set any bail for one Renato (surname withheld to protect his niece), a laborer, and resident of Ma-a, this city. Renato could no longer be found in his house after he committed the crime.

The girl's mother, Lina (not her real name), 28, a laundry woman filed the complaint.

In her affidavit, the victim's mother said she arrived home at around 8 p.m. on January 25 only to see Renato (brother of her husband) and her daughter both naked. Renato was kissing her daughter while the girl was sleeping.

Lina added that her other two children, Leah, 7 and Jun, 4, were both sleeping on the floor where Renato and her daughter were lying.

Lina said Renato fled on foot when he saw her. The following day, Lina said she confronted her children about what she saw.

Her daughter, Leah revealed that she saw her uncle undressed her sister while the latter was in deep sleep.

Leah added that Renato thought that she was already asleep but he did not noticed her peep through the holes of her blanket.

The victim, in a sworn affidavit, said she just felt that someone was on top of her that night, but that she didn't bother to awaken.

Lina said when she told her husband about what Leah told her, her husband got mad at her instead.

It was a pastor named Rodolfo Antolin whom Lina approached to ask advise from who told her to report the incident to the police.

The police, in turn, advised Lina to let her daughter undergo a medical check-up and it was confirmed that indeed her daughter showed signs of having been sexually molested.

On May, Lina decided to bring her children for temporary shelter at the Balangay Dangupan on SIR, Matina this city.

Lina said the Talomo police precinct already went to Renato's house several times but the latter could no longer be found. (JGR)
